Contract and Business Disputes


Perhaps the most common claim found in commercial litigation lawsuits is a claim for damages based on “breach of contract.”  To prevail on such a claim, the plaintiff must prove three things: 1) the existence of an enforceable agreement; 2) the unexcused breach or violation of a term of that agreement, and 3) damages suffered by the plaintiff because of that breach.  Sounds simple, and occasionally it is.  However, as described below, the successful determination of these three seemingly simple and straightforward elements rarely occurs without careful factual and legal preparation followed by persuasive presentations to a judge or jury.  Click here to see previous case results.
