Class actions permit a small number of “class representatives” with similar damage claims to represent hundreds or thousands of individually injured parties. Class actions are supposed to permit a more efficient resolution of relatively small claims that might not justify the cost of a single lawsuit. Class action procedures include an important safeguard. In most cases, individually injured parties may “opt-out” of the class action proceedings and proceed with their own case. I have been appointed as lead class counsel and represented groups of clients who opted out of class actions to negotiate private settlements.
